Subject: Scope of Application
These General Terms and Conditions apply to online games, mobile games, and other services, including but not limited to product information, offered by Guangzhou Huice Data Technology Co., Ltd. (“Huice Data”) on its website and app store.
Huice Data will continuously update, modify, and develop its online games, mobile games, and other services, and reserves the right to make such changes at its sole discretion. Therefore, users may only participate in the corresponding online games, mobile games, or other promotional activities in the manner provided at that time. Huice Data reserves the right to discontinue the operation of online games or mobile games, or remove specific services, at any time without further explanation.
The online games, mobile games, and other services provided by Huice Data are for entertainment purposes only. Commercial use of these games or services is strictly prohibited. Users are responsible for ensuring that their software and hardware are compatible and up-to-date.
In addition to these General Terms and Conditions, any existing rules relating to the relevant online or mobile games also apply. In the event of any conflict between these General Terms and Conditions and the game rules, these General Terms and Conditions shall prevail. In addition, certain online or mobile games, specific versions and/or components, and individual services offered on the Huice Data website are also subject to specific terms and conditions. Users will be informed of any specific terms and conditions before using the relevant services.
Contract Formation
To use the online and mobile games and other services offered by Huice Data, users must register and, if necessary, install the corresponding applications.
Registration is limited to natural persons. Only individuals can register as authorized users (groups, families, spouses, or partners are not accepted).
Children under the age of 13 are not permitted to register. Minors over the age of 13 must obtain permission from their legal guardian to register. If the relevant game or service has an age rating, the minimum age requirement must be met to register.
Use of the Huice Data Website and Website Content
The Huice Data website and mobile games contain various content protected by trademarks, copyrights, or other means, which is owned by Huice Data or third parties. Unless expressly permitted by these terms and conditions, users may not edit, copy, distribute, publicly reproduce, use for advertising purposes, or use the Huice Data website, mobile games, or any part thereof for any purpose other than those agreed upon in this contract. Technical copies may only be made for browsing purposes, and permanent copies may be made for private use. Copyright information and brand names may not be altered, hidden, or removed.
Limitation of Liability
Users shall be personally liable for any infringement of third-party rights. Users agree to indemnify Huice Data for all losses suffered as a result of breach of these Terms and Conditions. Users shall hold Huice Data harmless from all reasonable claims brought by other users or third parties for infringement of their rights or breach of other obligations. Users shall bear Huice Data's legal defense costs, including all court costs and attorneys' fees. These Terms shall not apply if the user is not liable for any infringement. Regardless of the legal basis, whether due to breach of contract or breach of obligation, Huice Data's liability shall ultimately be determined according to the following rules:
If Huice Data provides the corresponding liability services free of charge, Huice Data shall be liable only for willful misconduct and gross negligence.
Other
Huice Data reserves the right to modify these Terms and Conditions in the following circumstances: (a) any revision due to changes in law; (b) any revision due to a ruling by the Supreme Court or other bodies; (c) for technical needs; (d) to maintain the company's operations; (e) changes in market conditions; and (f) for the benefit of users. No revisions that would materially disrupt the balance of this contract will be made. Huice Data will notify users of any revisions to these General Terms and Conditions at least four weeks in advance via its website or corresponding online or mobile game. Alternatively, Huice Data may also send users an email containing the revised General Terms and Conditions.
